Get ready for Gun Control!

You fired up ready to go. Course you -- it's Monday. So -- So -- that Antonin Scalia Supreme Court justice goes on television we get to see. And we get to hear how always Supreme Court justice thanks always fun to see their personalities and gets another -- people little bit. Andy he I had some comments that worked and were surprising to people or controversial. Most controversial among them I would say it. Was his comments on. Guns. He sets. The door is open. To put some curbs. On gun rights and here's why he says. He says it because of his way of looking at the constitution. He is a textual list apparently. And that is somebody who looks of the tax and says let's just what let's read the text of statutes and apply them to the constitution based on. How the constitution was viewed. By the people who ratified it. So he goes back to what was it 1789. When the constitution was ratified and says. Let's. Let's compare. -- for example he used -- used as a way to demonstrate mr. Chris Wallace he said let's look at capital punishment. Clearly. -- for hung at the time. That the constitution was written. Before -- therefore it's ridiculous. To consider. The idea that that some other form of death penalty like the electric chair would be cruel and unusual punishment. Because obviously. The reason they brought in the electric chair. Is because it's more compassionate. It's less brutal. Then hang it. And affirmative firm that context that's how it looks like he's just look that's the constitution. If you want to limit that states can what are. They can pass laws change they can have any capital punishment they want. But. Obviously. If you look at the way capital punishment was done at the time of the constitution was written and ratified. You can see it's doing it was not believed to be cruel and unusual punishment that was the intent to the constitution. Bag begins and ends there. So let's listen to Justice Scalia. Talking about. Guns. In 2008. Did the opinion in District of Columbia V Heller. The majority opinion it's of the Second Amendment mean is what is sad is people have a right. To bear arms question. How far does that constitutional right got cam hey legislature ban. Semi automatic weapons or Kennedy -- magazines. They carry a hundred rounds. Without violating. An individual's constitutional right to bear arms. What the opinion Heller said is that you it will have to be decided in future cases. What limitations upon the right to keep and bear arms are permissible some undoubtedly are because there were some. That were acknowledged that the time. For example there was a torture called. Off right -- think we preach if you carried around a really horrible weapon just to scare people like and -- or something patent that was. I believe a misdemeanor. So. Yes there are some limitations that can be done in post. But what they are will depend on what to what the society understood reasonable limitations at the time we were certain location limitations. Where where what about these technological limitations obviously we're not now talking about a handgun -- must -- we're talking about it. A weapon that can fire a hundred shots in a minute. Will we will see what I mean. Obviously the the amendment does not apply to. Arms that cannot be hand carried six to keep and bear so doesn't apply to Canon's. There's an -- saying he's a great -- are which I never considered before. -- look how literal he's being about the constitution. It says to keep ended bear arms. And so he says that means if you can't carry them. If if they can't be borne by an individual IE will carried around city can't have a cannon but. You might be able to have a surface to air missile because that's something you can bear that's a weapon you walk around with this is how. Justice Scalia views the constitution. He says. It's that simple it doesn't matter. If the Supreme Court rulings seem outrageous. It doesn't matter if the Supreme Court rulings make the world less organized or more difficult. Their job is to take the statute. And apply it to the constitution. That's their job you're any problem with that. I like this approach I'm not sure if I -- justice. I think I would certainly this would be the basic premise I would take to looking at the constitution but I hate it when the only thing. It would probably be eighty or 90% what are they intended the time. Part of the challenges. There are certain things that come along that my eight. That might. Really not apply. When the constitution was ratified what was accepted by the society at that time any talks about it. He talks about the ratification of the constitution as the people. Deciding what kind of document they wanted to have -- what the rules were going to be. So voters voted as far as he's concerned back in the eighteenth century.
