Tom Finneran EAU while listening to figure it's for men we have on the line with us states senator Bruce Starr Republican from Gloucester. Who was filed a very comprehensive immigration bill -- got a hearing yesterday in front of the Judiciary Committee. Some sympathetic responses from I represented if you -- clarity the house chairmen senator -- Bob -- the Senate chairman. Lot of lot of stuff that he's put -- there is explain to us in the last segment and will obviously talk to continue to -- to senator Tara about governor Deval Patrick's likely response but let's take some calls on this a causal lit up. No surprise candidates are I think people -- you're able to stay with us we'll go right to Michael calling from -- mica you're on the it was state -- state senator -- dot.

A good morning good morning taking my call first solo and stop by same the arms speaker I'm hooked on your. Show about thank you very much like every morning thank you I want to expand on the the subject -- previous brought up about the workers coming from India and China yes and I H one BD son and -- American jobs and all that it's. And I'm not sure you're aware that today as a matter fact that. Mr. gates is in front of congress requesting that more -- one TDs as should be opened up. That are more. People from other countries can come in here work in the air and then you know replace American workers. Well I don't I don't understand why can be passed the law in Massachusetts just in Massachusetts saying that. Who want to do business in Massachusetts that'd that earlier employees should be a US citizen.

That that's the great question and one and I'm sure a lot of people would ask -- from time to time it's very difficult to be able to pass something of -- state nature. And that -- the field that have been occupied by the federal government so we may be able to do something that says that if you're gonna work for the state. Then you have to have that requirement I you're you're gonna be at -- contractor or you're gonna work directly or state agency it would be difficult for us to do that for private employers because that's field as been occupied and reserved to itself of the federal government.

Let me also -- Mike because I understand I think the you know that the that the frustration behind the the question. In the -- anxiety with -- American workers who find themselves displaced. I spent some time in the Biotech. Industry to buy it in and obviously medical device and high tech I think would have similar. Concerns they would say that they literally would call up in -- overwhelmed the switchboard right now and say hey we would love to -- We can't find the scientist at the molecular biologist the entity is insufficient quantity American engineers and scientists and like insufficient quantity it's so they feel obliged to reach out globally. You know people from Europe people from age of people from South America. To supplement there's a lot of pressure actually in congress to expedient just as you said. The the numbers of people who would be allowed to come in here on H one B visas particularly those who fall into the I'll call the high skill categories soft -- You know -- on software code right is that type of stuff and obviously the scientists and researchers associated with the Biotech community. Great frustration that we don't have. And off workers of American. Are originals at that way to field that fill the needs. Appreciate the call let's go to Paul is calling from data hey Paul what's going on.

That it isn't that there's a couple of things awards that -- the on the lots worker. You're wrong I mean Michigan and Michigan did -- a law that requires any state. Contractor any water trucks state subsidy anyone that subject that they could not outsource it jobs overseas. Batteries or awards. Mr. speaker this is two reasons I mean Michigan is eight saw on. Immigration and they have hundreds upon hundreds of nurses across the border every day from Canada and yet they were able to it would that democratic. Got the patsy very very strong anti overseas law or inside out privatization overseas law. And it's been very very fact that what it is. Make companies and in the majority of the big companies here in Massachusetts excluding them by. Excluding them buy back. Do business with the state in some former on the web and get tax subsidies and again. -- you know they're bidding on contracts or whatever and -- get very very effective. -- and I think Massachusetts has addressed that. Because the back in the law by a lot of -- call centers we other applications are being outsourced overseas and a lot of these big companies -- work in Massachusetts.

Let me let me give senator -- chance to respond to the example you -- in Michigan it's a -- you know its economic woes -- troubles Bruce very very well known I don't know if you know what is related to the other end of Jennifer -- on the democratic governor was. You know felt obliged to do something like this because of the economic anxieties up there but I'm curious is the -- take on now Paul's call in his recitation of the example and Michigan.

What pressure public -- like put up that I am not wrong that when we talk about state being able to outsource things that is an area that the states have some -- liberty to act upon if we're talking about private employers I would absolutely stick with the point that that would be struck down. And they may have been not yet challenged in the courts but it would likely be if it weren't it would not succeed. But Pollak write to the extent of the commonwealth and you put -- this just the few moments ago. The commonwealth could exercise that kind of a policy with regard to its own contract thing. And that may well be an important point with regard to lose some of the H one B visa programs I think that we need to have the federal government to ensure that if we're -- alone or folks -- those folks need to be filling positions. That -- not otherwise -- and that's an exercise it's always difficult but that's one of the things that we have to focus on our immigration policy. Should be used to supplement. The workforce that we already have and not a displaces.

Really could not acidity better than myself I do agree and I'm not a big big hey let's close the borders of let's just live within our broader economy with our when our -- Continental mass here I don't think that's realistic. But at the same time my recollection is senate at that. Before our company can fill a position with the work or from overseas they actually have to have posted the job for a period of time whether it's two weeks or a month I'm not exactly sure. But they actually I think it are required under federal law or a federal regulation to posted openly so and American with the right credentials and qualifications has the first shot at it.

My recollection promised that the Department of Labor at the very specific process by which you go through that exercise to determine. That you made in our friend the American marketplace and have not been able to find employees.

You know let's take continue to take calls we get -- good what's coming up Kevin from eleven -- Kevin yeah next with state senator Bruce dial.

Good morning gentlemen affect its economic well -- Sort of Qatar one other thing I -- you talk mostly about labor business and illegal immigration -- Garrett in illegal immigration are so many problems that are related to order especially here in Massachusetts. But I -- the pile ought to point out one thing that's. That'll -- legislate laws seem to want to take up and the cost of educating. These to be illegal immigrants from -- while. You know the people here in Massachusetts ordered English immersion in a couple years ago -- were totally ignored. -- by a legislature that's because. The legislator really in -- Iraqi Government headed by pat style democracy and no one else he wants to bring money back to the cities and people look up reps. Again and Tony back on the on the dollars a based -- the Beacon -- while the cities to get -- back. On -- dollar and that's because they have to educate the illegal in the immigrants. I'd like to know your take on that sort of.

I think Kevin you make a couple of reports one of the first things that I need to say that represents seventeen. Suburban communities no major cities and one of the things that I have been arguing for the last number of years that the try to make the foundation formula. By which we share revenue with their communities for education more fair I would argue to you that the chapter seven formulas it's officially known it's completely unfair. And we need to change it to recognize the needs of suburban communities as well as urban communities that that takes money. But I would suggest you but it was spending bill was unfairly that the demands for reform. Second of -- with regard to the kids that you make reference to. That is an issue with the legislature to my intelligent and the speaker could do it makes some reference to that as well from his own experience. Has not acted but my understanding is that -- lot of the public policy thought behind that is that it's better to have these folks in school. And being brought into the culture and given an education for the picking one to become productive citizens. Is better than not allowing that this happened but I understand. The consequence of that is that it has a tremendous hospital local school systems and and again I would argue. That we have not been nearly enough. -- recognized in need of all of those schools.

You know there's no question -- idea and I say this is an urban legislator of former vocalist but -- but legislator I do think the formula was deliberately. -- that at some might say too too much. But -- deliberately -- the because there was a recognition that the pressure is that the gentleman that the other caller mentioned a really more acute and more pronounced even more acute and pronounced in an urban setting as opposed to suburban but it ain't easy for anybody and I don't need to. Just offering kind of ugly of the response let's go to Pedro calling from -- Massachusetts -- you run EO Tom Finneran in state senator brute stop.

More of mister speaker -- and -- morning good morning I don't. The morning on a construction company also work to do what -- Austin and one of my problems aren't my cup and as a unit conference's. Is that even own neighborhood it would work. This nonprofit organization that get money from the state from the city from the federal down a little bit about. Them again. -- any -- time when they hired at when they hired a contractor he. Passing union contracts -- of them being mean Mike come to being in any legitimate. Contracts. Can never compete against some of the players and enable it. Because and then that pleasant and I've not been able. It's on the outside that come in bring people in there and and all would only be played -- outweighed a limit. Yeah this is. And saying oh I'm gonna people's. So it was a silly argument that you think well that's not the point. And I came he came legally. And now works are. And I -- this country and that there isn't applicable rules why soldiers people.

Pedro great point that classic American experience to come illegally you work had you looking for opportunity BC employee years. Exploiting. Illegal aliens taking advantage of them giving them low ball wages and then cutting you and other. Legitimate -- contract is out of the process because you can't compete on wages. Senator -- exactly what you and I talked about in the last -- in the last segment how what and how that's creating conflict even within the democratic product.

Exactly the point and I can sympathize with Pedro and -- situation is one of the reasons why we're trying to make some change particularly. Commonly using tax dollars and Pedroia sympathize with if we shouldn't be subsidizing illegal activity that then displaces a legitimate contract from being able to compete on a level playing field that automatic. One point because it goes opened the door to a just a little bit is that I've always been and will continue to be a supporter of those who come to this country legally. Looking for an opportunity for themselves and their families in fact I've worked with others including senator Marian Walsh. Over the last few years to try to infuse hundreds of thousands of dollars into the system will allow people want to come to this country. Who want to get their visas who want to get their green cards to want to learn English want to go to school and do things the right way be able to do so but that doesn't mean. That we should be turning the other way when someone doesn't want to they abide by the rules and that's -- this so we'll look -- longer than not you lot of the -- in terms of competition.

Here you know and the -- thick of it this bill that you filed senate tie gives you great opportunity entire legislature -- in Republicans a chance to really come together and find the important. The important points of agreement so that it can become a little bit more coherent than it is for the page rest of the world because -- consummate like through no fault of his own and notwithstanding immense. After that you know he's getting screwed you know again through no fault of his own let's go to lab -- going to hold on I'm alive for a while Bennett scholar from an embed -- the -- state senator Bruce stop.

Eight bury you agree that I present. And other Republican. Does that I think it is we. As a people have -- a tremendous opportunity it every bit rot in leader. That the real basic package as it relates to John McCain. I hear what more person -- immigration reform. And a positive thing. Head explode because all -- immigration reform at the starting with John McCain. Is essentially -- that one think about immigration laws that works and it make it all -- at slippery rock my question is. -- That. We've had democratic two democratic houses. And a president. Who is in the lap of America.

I think it probably won't read only -- because this is an issue that needs to be addressed and so you're an -- like the way candidate gets addressed. But I think it's gonna continue to be a political hot button at the congress send any administration's gonna feel compelled to act on but then I also want to make a point that that you referred to. With governor Romney as governor he did in fact put in place than a memorandum. -- pursuant law that I described earlier between the state police. And ice the immigration customs enforcement folks to enforce the laws of the country. Under the new administration -- that agreement was -- and removed from being in practical -- however this administration has tried to do something that I would commend them for but it would regard to your point I don't think immigration -- going to go away nationally. And you and I may not like the result in the a lot of discussion of amnesty. There's a lot of discussion of alone people to move to the front of the line. Who came to this country illegally and I don't think that's an acceptable resolution to the issue although I do think border security will continue to be something will be addressed regardless of who's in the corner office or in the White House and regardless of who's in the congress.

You know -- identified himself as -- Republican -- can say this -- a Democrat I agree with you I don't think it's going to go away I do think it'll be important for all Americans be vigilant on -- beyond belief because I also agree with you -- those who came here illegally should not just jump to the front line you can't send that signal to somebody who went to a consulate office are an embassy got in -- it's -- 5678. Years -- has played by the rules -- still waiting at -- going on everybody's running by -- in getting in there -- get a pat on the back and -- the election --

A print reporter targets they ask me why I was doing this and how rampant this wasn't was trying to cite examples. The reason for that one of the underlying point for the reason that all of my colleague and by the way -- cosponsor ship in both branches and in both parties and so. This is not only Republican issue -- a lot of folks with fuel that we need to take action and there are some very notable folks that have been supportive of this including Democrats like Tony -- the door in the wind while he's not a sponsor of this particular measure was very supportive on the floor of the Senate of other issues senator -- are other people who has said we need to address this. But the point is that one of the fundamental elements of our society is that we govern based on the fact that the law has integrity if we closet not to have integrity. Then we it was a very important point of the social compact by which we always.

Let's give us sit here a quick shot at this she scholar from the cape by Iran -- what senator Bruce tests that they were right up against -- clock.

I don't have much more my big question. I you mentioned that this was the require verification for employers that do business with the state. Why not extend that to any heavy license from the state that would fit into Egyptian military. Pro Contra.

Actors it's a good point -- we have an export going that far with the law yet but it's one of the good reasons again why we have a legislative process to make a good point. We can look at that. One of the challenging part about this bill that we've been trying to be as close to what the federal government will allow us to do without stepping over the line I think you make a good point we need to which Florida don't have a good answer we're -- will researcher at. And maybe that can become part of the Billiton moved out of the committee that will let slip across.

ago that is the voice of state senator -- dobbs -- thank you -- he's been great to give us the extra time to respond as you -- topical I -- big big topic all the time I think we handled that in -- what I would characterize as a bipartisan and statesman like -- not surprised because you are involved -- on the other side likes that and if anybody has any -- I like this guy like state senator -- Republican from -- like to keep everybody -- about the -- gone on up there on Beacon -- and think senator -- dot.
